Terms of Use

These Terms of Use ("Terms") are an agreement between you and Dozer Studios LLC, an Illinois limited liability company ("we", "us"). They cover The Players Clubhouse iPhone and Android apps and tpclubhouse.com (together, "the app"). By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

1. Who can use the app

You must be at least 13 years old. If you're under 18, or under the age of majority where you live, a parent or legal guardian must agree to these Terms for you. You may not use the app where the law prohibits it.

2. Your account

  • Give accurate information and keep it up to date.
  • Keep your password private. You're responsible for activity on your account.
  • Your account is for you alone. Don't share it or create accounts for other people. Use guest players for friends without an account.
  • Tell us right away at tim@dozerstudios.com if you think someone else has accessed your account.

3. Clubhouses and other players

Clubhouse owners and organizers decide who joins, how their group runs, and what happens to events and tee times. Disagreements between players, about scores, side games, or anything else, are between those players. We may help where we can, but we aren't responsible for how other people use the app.

4. Your content

You own what you put in the app: scores, posts, comments, photos, and other content. You give us a worldwide, non-exclusive, royalty-free license to store, display, and share it as needed to run the app. For example, we show your scores to the people in your rounds and clubhouses, as described in the Privacy Policy. This license ends when you delete the content or your account, except for scores in shared rounds, which stay in other players' history without your name.

You're responsible for your content. If you add a guest or invite someone, you confirm you have their permission to share their information with us.

5. Rules of conduct

Don't use the app to:

  • harass, threaten, or impersonate anyone, or post hateful, sexual, or violent content;
  • post someone else's private information, or anything you don't have the right to share;
  • run real-money gambling or any other illegal activity;
  • spam people, or send invitations to people who don't want them;
  • break, overload, scrape, or reverse-engineer the app, or get around its security or limits;
  • access accounts or data that aren't yours.

We don't tolerate objectionable content or abusive users. You can report a comment or a member, or block a member, from the ⋯ menu in the app. We review reports within 24 hours, and we may remove content or suspend accounts that break these rules.

6. Money, entry fees, and credits

The app doesn't handle money between players. We don't collect, hold, transfer, or pay out money for any game. An event's entry fee is shown for information only and is paid to the organizer outside the app. Skins are scored without money. If you and your friends agree to play for money, that arrangement is solely between you. You're responsible for following the laws where you play.

Earlier versions of the app had in-app credits for side games. Credits aren't available now. Any credits left from before have no cash value, can't be bought, sold, or exchanged for anything of value, and aren't your property. We may adjust, reset, or remove them.

7. Subscriptions

We may offer an optional paid subscription ("Pro"). If you buy one:

  • The price, billing period, and features are shown before you buy.
  • Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends.
  • Bought in the iPhone app: Apple charges your Apple Account. Manage or cancel it in your device's Settings under your name → Subscriptions. Refunds are handled by Apple under its policies.
  • Bought in the Android app: Google Play charges your Google account. Manage or cancel it in the Play Store under Payments & subscriptions.
  • Bought on the website: our payment processor, Stripe, charges you, and you can cancel anytime. Payments are non-refundable except where the law requires otherwise.
  • If we offer a free trial, it converts to a paid subscription at the end of the trial unless you cancel before then.
  • Deleting your account doesn't cancel an App Store or Google Play subscription. Cancel it first, as described above. Website subscriptions are cancelled automatically when you delete your account.
  • We may change prices or Pro features. Price changes take effect at your next renewal, and we'll tell you about them in advance.

8. Handicaps, GPS, courses, and GHIN

  • Handicaps calculated in the app follow the World Handicap System as closely as we can, but they're estimates for friendly play. They aren't an official Handicap Index unless they come from GHIN.
  • GPS distances, course details, and other golf information may be inaccurate or out of date. Use your own judgment on the course.
  • If you link GHIN, you authorize us to sign in to GHIN with the credentials you provide to get your handicap information. GHIN and USGA are trademarks of the United States Golf Association. We aren't affiliated with or endorsed by the USGA.
  • The app includes services from other companies, such as maps and course data. Their terms may also apply.

9. Our app

The app, including its design, code, and branding, belongs to Dozer Studios LLC. We give you a personal, non-transferable, revocable license to use it for its intended purpose under these Terms. If you send us ideas or feedback, we may use them without owing you anything.

10. Ending your use

You can stop using the app and delete your account at any time. We may suspend or close your account if you break these Terms or if we stop offering the app. When possible we'll tell you first. Sections 4 (license to shared scores), 6, and 11 through 15 survive after your account ends.

11. Disclaimers

The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the app will always be available, error-free, or secure, or that scores, handicaps, distances, or other information will be accurate.

12. Limitation of liability

To the fullest extent the law allows, Dozer Studios LLC and its owner won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.

13. Indemnity

If someone brings a claim against us because of your content, your conduct, or your breach of these Terms, you agree to cover our reasonable losses and costs, including legal fees, to the extent the law allows.

14. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. If a dispute comes up, please email us first. Most problems can be solved that way. Any dispute that can't be resolved informally will be decided in the state or federal courts located in Illinois, and you and we consent to those courts' jurisdiction.

15. Apple App Store and Google Play

If you downloaded the app from Apple's App Store:

  • These Terms are between you and Dozer Studios LLC only, not Apple. We, not Apple, are responsible for the app and its content.
  • Your license to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • We, not Apple, are responsible for investigating and defending any claim that the app infringes someone's intellectual property rights.
  • You confirm you aren't located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you aren't on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the app from Google Play, Google Play's terms also apply to your download and any purchases.

16. Changes to these Terms

We may update these Terms. If a change is material, we'll let you know in the app or by email before it takes effect. If you keep using the app after that, you accept the new Terms.

If any part of these Terms can't be enforced, the rest still applies. These Terms and the Privacy Policy are the entire agreement between you and us about the app.
